Mayoral Proclamation Lifting and Rescinding Curfew
WHEREAS, on March 13, 2020, the Governor of the State of South Carolina (“State”) issued Executive Order No. 2020-08, declaring a State of Emergency based on a determination that the 2019 Novel Coronavirus (“COVID-19”) poses an actual or imminent public health emergency for the State;
WHEREAS, also on March 13, 2020, the President of the United States (“President”) declared that the COVID-19 outbreak in the United States constitutes a national emergency, which began on March 1, 2020;
WHEREAS, the Governor has issued Executive Orders 2020-09, 2020-10, 2020-11, 2020-12, 2020-13, 2020-14, 2020-15 ,2020-16, 2020-17,2020-18, 2020-19, 2020-20, 2020-28, 2020-29, 2020-30, 2020-31, 2020-34 and 2020-36 to prepare for and respond to the actual, ongoing, and evolving public health threat posed by COVIN-19;
WHEREAS, by Mayoral Proclamation dated April 8, 2020 a state of emergency was proclaimed in the City of Orangeburg and a curfew was ordered beginning April 9, 2020 between the hours of 11:00 P.M. and 6:00 A.M.;
WHEREAS, the said Mayoral Proclamation was ratified and extended by City of Orangeburg Ordinance 2020-02 dated April 16, 2020, which included the grant of authority to the Mayor to terminate the Proclamation in its entirety or by section;
WHEREAS, Executive Orders 2020-31, 2020-34 and 2020-36 of the Governor rescinded the “Stay at Home” provisions of Order 2020-21, authorized limited indoor, on-premises customer dining and re-opened recreational, athletic facilities and activities and close-contact service providers.
WHEREAS, the Mayor has determined as a result of the Executive Orders 2020-31, 2020-34 and 2020-36 of the Governor it is now advisable to lift and rescind the present curfew in the City of Orangeburg;
NOW, THEREFORE, the Mayor of the City of Orangeburg does hereby declare as that the curfew imposed by Section 4 of the Mayoral Proclamation of April 8, 2020 and extended by City Ordinance 2020-02 is hereby lifted and rescinded as of the date hereof, including enforcement Section 6.
Except as amended herein, the Mayoral Proclamation of April 8, 2020 shall remain in full force and effect.
